The Litigation Process in Panamá

Generally, litigation will include the following steps:

  1. The initiating party (the plaintiff) will file a complaint in court.
  2. After it is admitted, the court will notify the defending party (the defendant). In cases involving corporations, courts will generally contact their legal representatives. 
  3. The defendant has the chance to respond, and the court arranges an appearance.
  4. At the appearance, parties have the chance to reach an agreement. If this happens, the judge will finalize it, and parties must adhere to the terms of the agreement. 
  5. Should parties fail to reach an agreement, the judge will schedule a trial. At this meeting, parties will have a chance to present further evidence and make their cases. 
  6. A trial will conclude with the judge delivering a legally binding decision.
