The Litigation Process in Panamá
Generally, litigation will include the following steps:
- The initiating party (the plaintiff) will file a complaint in court.
- After it is admitted, the court will notify the defending party (the defendant). In cases involving corporations, courts will generally contact their legal representatives.
- The defendant has the chance to respond, and the court arranges an appearance.
- At the appearance, parties have the chance to reach an agreement. If this happens, the judge will finalize it, and parties must adhere to the terms of the agreement.
- Should parties fail to reach an agreement, the judge will schedule a trial. At this meeting, parties will have a chance to present further evidence and make their cases.
- A trial will conclude with the judge delivering a legally binding decision.
